This bill designates the production of electricity from resource recovery facilities that meet the standards of performance for large municipal waste combustors regulated pursuant to 40 C.F.R. s.60.52b and 40 C.F.R. s.60.53b, as Class I renewable energy production. Resource recovery facilities that meet such standards are designated by the federal Environmental Protection Agency as "municipal waste combustor units with a combustion capacity greater than 250 tons per day of municipal solid waste for which construction, modification, or reconstruction is commenced after September 20, 1994." These recently-built or modified facilities must meet the stronger air pollution requirements than facilities built prior to that date and therefore have lower emissions and less of a negative impact on the environment. As such, the distinction between these types of facilities should be recognized and the benefits of "Class I" status bestowed on the recently-built or modified facilities as a provider of "green jobs" to the State economy.
