This bill permits "high-performing" nonpublic schools, defined as those scoring in the top third on standardized achievement tests, that are located in "failing school districts" (districts needing improvement under the "No Child Left Behind Act of 2001") to convert into charter schools. Upon conversion, these schools must prohibit religious instruction, events, and the display of religious symbols, and their names cannot have religious references. The Commissioner of Education will have a process to review these conversion applications, and the bill clarifies that students previously enrolled in the nonpublic school remain eligible, with preference given to them for enrollment. Existing staff can continue employment, but must meet certification requirements within two years. The bill also amends existing law to remove the prohibition against private or parochial schools becoming charter schools and allows converted charter schools to remain in their original buildings.
