This bill proposes to amend the New York state constitution to include a new section that guarantees equality of rights and protection against discrimination based on race, color, ethnicity, national origin, disability, sex (including pregnancy and pregnancy outcomes), sexual orientation, gender identity, and gender expression. It also prohibits discrimination by government entities, entities acting on behalf of the government, and entities providing public accommodations, employment, or personnel practices. The bill further states that claims of religious discrimination will be analyzed under the same standards as claims under the existing religious freedom protections. Finally, the bill allows for the adoption of laws, regulations, or practices designed to remedy past discrimination, and declares the section to be self-executing, with the legislature able to expand upon the secured rights.
