This bill amends the Insurance Code to require policyholders to pay any deductible applicable to a first-party claim under a property insurance policy. The bill also creates a criminal offense for sellers of goods or services who knowingly allow policyholders to avoid paying the required deductible, such as by waiving, absorbing, or providing a rebate for the deductible amount. The bill directs the Texas Department of Insurance to develop an education program related to the payment of property insurance deductibles. The changes made by this bill to the existing law apply only to offenses committed on or after the effective date of September 1, 2019.
