Bill Summary

Legislative Counsel's Digest: This bill prohibits an officer or employee of this State or any political 1 subdivision thereof or any other person from: (1) requiring another person to 2 undergo the implantation of a microchip or other permanent identification marker 3 of any kind or nature; (2) establishing a program that authorizes a person to 4 voluntarily elect to undergo the implantation of such a microchip or permanent 5 identification marker; or (3) participating in a program established by another 6 person, if the program authorizes a person to voluntarily elect to undergo the 7 implantation of such a microchip or permanent identification marker. This bill also 8 defines microchip for the purposes of this bill. 9 SENATE AND ASSEMBLY, DO ENACT AS FOLLOWS: Section 1. Chapter 200 of NRS is hereby amended by adding 1 thereto a new section to read as follows: 2 1. An officer or employee of this State or any political 3 subdivision thereof or any other person shall not: 4 (a) Require another person to undergo the implantation of a 1 microchip or other permanent identification marker of any kind or 2 nature; 3 (b) Establish a program that authorizes a person to voluntarily 4 elect to undergo the implantation of a microchip or other 5 permanent identification marker of any kind or nature; or 6 (c) Participate in a program established by another person, if 7 the program authorizes a person to voluntarily elect to undergo 8 the implantation of a microchip or other permanent identification 9 marker of any kind or nature. 10 2. A person who violates the provisions of this section is 11 guilty of a category C felony and shall be punished as provided in 12 NRS 193.130. 13 3. As used in this section: 14 (a) Microchip means a device that is subcutaneously 15 implanted in a person and that is passively or actively capable of 16 transmitting personal information to another device using radio 17 frequency technology. 18 (b) The term does not include a device that is subcutaneously 19 implanted in a person, if the device: 20 (1) Is incapable of passively or actively transmitting 21 personal information to another device using radio frequency 22 technology and the device: 23 (I) Is used for the purpose of self-expression; or 24 (II) Is used in the diagnosis, monitoring, treatment or 25 prevention of a health condition; or 26 (2) Is capable of passively or actively transmitting personal 27 information to another device using radio frequency technology 28 and the device: 29 (I) Is used in the diagnosis, monitoring, treatment or 30 prevention of a health condition; and 31 (II) Only transmits such information as is necessary to 32 carry out the diagnosis, monitoring, treatment or prevention of the 33 health condition. 34
