This bill would prohibit the intentional release of balloons inflated with lighter-than-air gas, as it has been found to pose a danger and nuisance to the environment, particularly to wildlife and marine animals. The prohibition would not apply to balloons released for scientific or meteorological purposes on behalf of a governmental agency, hot air balloons that are recovered after launching, or balloons released and remaining indoors. Violators would be subject to a civil penalty of up to $500 per offense, with the release of multiple balloons at one time considered a single offense. The Department of Environmental Management would be tasked with promulgating rules and regulations to implement and carry out the provisions of this new chapter. The bill would take effect on November 1, 2020.
