This bill authorizes the Board of Trustees of State Institutions of Higher Learning, acting on behalf of the University of Southern Mississippi, to enter into a long-term services agreement (up to 50 years) for the operation, repairs, maintenance, and/or capital improvements of the university's utility system. The services agreement is considered a personal service contract, exempting it from the state's procurement requirements. The agreement and any amendments are subject to the Board's approval and cannot be cancelled by successor boards due to the binding successor doctrine. The university can negotiate the terms of the agreement and consent to the private or nonprofit entity pledging its interest to secure its obligations. The revenues and proceeds from the agreement must be used for the benefit of the university, and the property and materials involved are exempt from taxation. The bill also includes a severability clause and an effective date.
