This bill creates a new section of the Wisconsin statutes (939.76) that allows for the expungement of criminal court records in certain cases. Under the bill, if a defendant is acquitted of all charges or all charges are dismissed, the court must order the record of the case to be expunged if the charges are eligible, which includes any misdemeanor or certain felony violations related to motor vehicles, except those involving injury. The court may also order expungement of a felony case that did not result in a conviction if the court determines that the defendant will benefit from it and society will not be harmed. The bill also allows individuals to petition the court for expungement of past cases that meet these criteria, even if the acquittal or dismissal occurred before the bill's effective date.
