This bill amends the Medical Marihuana Facilities Licensing Act to modify the proof of financial responsibility criteria for medical marihuana licenses. The key provisions of the bill are: 1. The Marijuana Regulatory Agency, rather than the Department, will grant or renew medical marihuana licenses and require licensees or applicants to file proof of financial responsibility for liability resulting from the manufacture, distribution, transportation, or sale of adulterated marihuana or adulterated marihuana-infused products in an amount not less than $100,000. 2. The bill specifies acceptable forms of proof of financial responsibility, including cash, unencumbered securities, liability insurance, and a constant value bond. 3. The bill requires the proof of financial responsibility to cover bodily injuries to qualifying patients, including those caused by the intentional conduct of the licensee or its employee or agent, except for injuries caused with the intent to harm. 4. If a licensee fails to maintain the required proof of financial responsibility, the Marijuana Regulatory Agency must immediately suspend the licensee's license until the requirement is met.
