This bill establishes a presumption that school employees who contract COVID-19 have an occupational disease arising out of and in the course of their employment, making them eligible for workers' compensation benefits. To qualify, the employee must have been employed as a teacher, administrator, or in a student-related service role, and their COVID-19 diagnosis must be confirmed by a positive test or documented by a licensed medical provider. The presumption can only be rebutted if the employer or insurer shows the employment was not a direct cause of the disease. The bill also requires the commissioner to provide reports on COVID-19 workers' compensation claims under this provision. The bill is effective immediately and applies retroactively to July 15, 2020, but sunsets on July 30, 2021.
