This bill provides protections for the exercise of religious freedom in South Dakota. It prohibits state agencies, political subdivisions, and their officials and employees from substantially burdening a person's exercise of religion, unless the burden is essential to further a compelling governmental interest and is the least restrictive means of doing so. It also prohibits treating religious conduct more restrictively than comparable secular conduct due to economic reasons or concerns. The bill allows individuals who are aggrieved by a violation of these provisions to file a lawsuit for damages, injunctive relief, or other appropriate redress, and recover reasonable attorney's fees and costs if they prevail.
