AI Summary

This bill, known as the "Born-Alive Abortion Survivors Protection Act," establishes that a child born alive during or after an abortion or attempted abortion shall have the same rights and privileges as any other person in the state. It requires healthcare providers present during such a birth to exercise the same level of care and diligence to preserve the life and health of the child as they would for any other newborn. The bill also creates civil liability for those who knowingly or negligently cause the death of a child born alive, fail to comply with the care requirements, or aid in unlawful abortions. Additionally, the bill allows for personal injury or wrongful death lawsuits in certain circumstances related to unlawful abortions or self-induced abortions, including for the loss of future fertility, loss of companionship, and other damages. The bill also specifies that certain defenses, such as assumption of risk or consent, are not permitted in these lawsuits.
