Bill Summary

AN ACT To repeal section 393.135, RSMo, and to enact in lieu thereof two new sections relating to construction costs of certain new electric generation facilities.

AI Summary

This bill modifies provisions relating to the construction costs of certain new electric generation facilities in Missouri. It repeals the existing Section 393.135 and enacts two new sections, 393.135 and 393.1250. The key provisions include: 1. Allowing electrical corporations to recover the costs of "construction work in progress" for "clean baseload generating plants" (new nuclear-powered facilities) and "renewable source generating facilities" that are rated at 200 megawatts or more. This is an exception to the previous prohibition on recovering such costs before a facility is fully operational. 2. Defining "construction work in progress" as the electrical corporation's share of capital costs incurred but not yet included in the plant's in-service assets. 3. Enabling the Missouri Public Service Commission to authorize electrical corporations to make charges for service based in part on additional amortizations to maintain the corporation's financial ratios, to better enable the construction of these new generation facilities. 4. Granting the Commission rulemaking authority to assist in implementing this new law.
