This bill amends the Uniform Controlled Dangerous Substances Act in Oklahoma. It updates the language around prohibited acts and penalties for possessing controlled substances. The key provisions are: 1. It makes possession of a controlled substance a misdemeanor, punishable by up to 1 year in jail and a $1,000 fine. For a second offense within 10 years, the court can order the defendant to complete a substance abuse assessment and diversion program instead of other punishments. 2. For a third offense within 10 years, it is still a misdemeanor punishable by a fine, jail time, or both, but the court can again order an assessment, evaluation, and diversion program. 3. A fourth offense within 10 years becomes a felony, punishable by a fine and 1-5 years in prison, but the court can defer judgment and order the defendant to complete an assessment and diversion program, which would then change the felony to a misdemeanor upon successful completion. 4. These provisions do not apply to possession of marijuana. The bill also requires a $100 trauma-care fee to be paid by anyone convicted under this law. It takes effect on November 1, 2023.
