This bill requires certain state licensing boards, defined as "qualifying boards" where a majority of members are active in the regulated occupation, to submit proposed actions that could negatively impact competition to the Secretary of State for review. These "proposed qualifying actions" include things like affecting a group of people, contested actions, or revoking a license. The Secretary of State will have 60 days to determine if the action enforces a clear state policy, and the board must then follow the Secretary's recommendation. Failure to do so is considered misconduct and can lead to board members' removal. However, actions that don't have anticompetitive effects, such as those agreed to by the respondent, resulting from a criminal conviction, or merely imposing a fine or educational requirement, are exempt from this review process. The bill also clarifies that certain actions are not considered anticompetitive and allows boards to request a determination from the Secretary of State about whether an action qualifies for review. This new law will take effect on November 1, 2026.
