This bill, known as the Kentucky Student Privacy Act, establishes new rules for student access to school restrooms, locker rooms, and shower rooms. It defines "biological sex" as the physical condition of being male or female, determined by chromosomes and identified by anatomy at birth. The bill mandates that all multi-use restrooms, locker rooms, and shower rooms in public schools must be designated for either male or female students only. It also requires schools to provide separate, private areas for students who may be undressed in the presence of others, based on their biological sex. For students who identify as a gender different from their biological sex, and whose parents provide written consent, the bill outlines that they will be accommodated but will not be allowed to use facilities designated for the opposite biological sex when other students of that sex are present or could be present; acceptable accommodations include single-stall restrooms, unisex bathrooms, or controlled use of faculty facilities.
