This bill phases out single-use carryout bags by implementing a tiered approach, starting on October 1, 2015, when stores must charge at least ten cents for any single-use carryout bag, with collected funds used for compliance, bag costs, and customer education campaigns that encourage the use of reusable bags. By October 1, 2017, stores will be prohibited from providing single-use carryout bags altogether, but can offer 100% recyclable, compostable, or recycled paper bags for a minimum charge of ten cents, continuing the education and awareness efforts. Finally, as of October 1, 2019, stores will only be permitted to provide or sell reusable bags that meet specific criteria, such as having handles, being machine washable, and being made of durable, non-toxic materials, with local ordinances on bag use being superseded by these state-wide regulations. The bill also defines terms like "compostable bag," "recycled paper bag," "reusable bag," and "single-use carryout bag" to clarify its scope, and allows municipalities to fine stores for violations, with penalties increasing for repeat offenses.
