Bill Summary

An act to add Section 3055 to the Penal Code, relating to parole.

AI Summary

This bill establishes an Elderly Parole Program for prisoners who are 60 years of age or older and have served a minimum of 25 years of their current sentence, a change from the previous eligibility of being 50 years old and having served 15 years. When considering parole for these individuals, the Board of Parole Hearings (BPH) must specifically evaluate how their age, time served, and any diminished physical condition might reduce their risk of future violence. The BPH will also consider an inmate's eligibility for this program when scheduling their next parole suitability hearing. If an inmate is found suitable for parole under this program, they will be released on parole. This program is administered by the BPH and does not apply to prisoners sentenced to death or life without parole.
