This bill as amended would upgrade simple assault to aggravated assault when a person causes bodily injury by strangling the victim in the course of an act of domestic violence. "Bodily injury" is defined in N.J.S.2C:11-1 as physical pain, illness or any impairment of physical condition. Under the provisions of the bill as amended, causing bodily injury to another by strangling the person in the course of committing an act of domestic violence, as defined in section 3 of P.L.1991, c.261 (C.2C:25-19), against the person would constitute the third degree crime of aggravated assault. If the person does not suffer bodily injury, strangling the person in the course of committing an act of domestic violence against the person would constitute the fourth degree crime of aggravated assault. A crime of the third degree is punishable by a term of imprisonment of three to five years, a fine of up to $15,000, or both; a crime of the fourth degree, by a term of imprisonment of up to 18 months, a fine of up to $10,000, or both.
