This bill would expand the definition of "public building" for purposes of the State's drug distribution laws. Under current law, it is a crime of the second degree to distribute, dispense, or possess with intent to distribute a controlled dangerous substance while in, on, or within 500 feet of certain premises, including a "public building." It is a crime of the third degree if the violation involves less than one ounce of marijuana. The statute defines "public building" as "any publicly owned or leased library or museum." This bill would expand the definition of "public building" to also include any publicly owned or leased recreation facility or community center. A crime of the second degree crime is punishable by a term of imprisonment of five to 10 years or a fine up to $150,000, or both. A crime of the third degree is punishable by a term of three to five years or a fine up to $15,000, or both.
