This bill requires motor vehicle inspection stickers to notify drivers that they are subject to a penalty for texting while driving. Current law provides that "certificates of approval," which indicate that a motor vehicle has successfully passed inspection, may be in the form of a windshield sticker or a license plate decal. The bill provides that any certificate of approval in the form of a windshield sticker is to display the words "U Text U Drive U Pay" so as to be visible to the operator of the motor vehicle. The fines for using a telephone or electronic communication device to send a text message or electronic message while operating a motor vehicle are as follows: · First offense - not less than $200 or more than $400; · Second offense - not less than $400 or more than $600; and · Any subsequent offense - not less than $600 or more than $800. Additionally, for a third or subsequent violation, the court, in its discretion, may order the person to forfeit the right to operate a motor vehicle over the highways of this State for a period of 90 days. A person convicted of a third or subsequent violation will also be assessed three motor vehicle penalty points.
