This bill amends Michigan law to require public notice and an opportunity for a public hearing before a permit is issued for hydraulic fracturing, a process involving injecting foam or fluid under pressure into a well to create fractures and enhance hydrocarbon production. Specifically, it adds a provision to Section 61525 of the Natural Resources and Environmental Protection Act, which governs oil and gas well drilling permits. Under the proposed changes, if a request is made by the local city, village, or township, or by any person who may be adversely impacted (including those whose water supply could be affected), the Department of Natural Resources must hold a public hearing in the affected area before deciding on an application for a permit that includes hydraulic fracturing. At this hearing, interested parties will be allowed to submit written comments and recommendations, which the supervisor of wells must consider.
