This bill, by creating a new act, prevents local governments in Michigan from enacting or enforcing ordinances that regulate, prohibit, restrict, or impose fees on "auxiliary containers," which are defined broadly to include bags, cups, bottles, or other packaging made from various materials and designed for transporting or protecting merchandise, food, or beverages. However, this preemption does not apply to curbside or commercial recycling programs, designated recycling locations, ordinances prohibiting littering, or the use of auxiliary containers on property owned by the local government itself.
