This bill would upgrade the penalties for assaulting school personnel. Under current law, an assault against school personnel described as "any school board member, school administrator, teacher, school bus driver or other employee of a public or nonpublic school or school board while clearly identifiable as being engaged in the performance of his duties or because of his status as a member or employee of a public or nonpublic school or school board or any school bus driver employed by an operator under contract to a public or nonpublic school or school board while clearly identifiable as being engaged in the performance of his duties or because of his status as a school bus driver," is a crime of the third degree if the person suffers bodily injury, otherwise it is a crime of the fourth degree. This bill would make such an assault against school personnel a crime of the third degree in all instances regardless of whether the victim suffered bodily injury. A crime of the third degree is punishable by a fine of up to $15,000, imprisonment for a term of between three and five years, or both.
