This bill prohibits the sale of powdered caffeine in this State. Under the provisions of the bill, a person who sells, offers for sale, or gives powdered caffeine to any person is a petty disorderly person. A person who commits a second or subsequent offense is a disorderly person. A petty disorderly person's offense is punishable by a fine of up to $500, a term of imprisonment not to exceed 30 days, or both. A disorderly person's offense is punishable by a fine of up to $1,000, a term of imprisonment not to exceed six months, or both. The bill defines "powdered caffeine" as a product containing 100 percent caffeine in powdered or crystalline form. The definition specifically excludes caffeine pills, tablets or caplets containing 200 milligrams or less of caffeine per dose, as well as coffee, tea or any other substance meant for human consumption that contains some amount of caffeine combined with other ingredients or components.
