This bill provides that, under an employee leasing agreement, a client company may, in agreement with the employee leasing company at the inception of the employee leasing agreement, elect to assume the responsibility of providing the workers' compensation insurance coverage for its employees. The bill further provides that if the client company elects to assume the responsibility of providing workers' compensation insurance, the client company shall have sole responsibility for the management of workers' compensation claims, and all related filings and procedures. Finally, the bill reaffirms that the exclusivity of the workers' compensation remedies applies to both the employee leasing company and the client firm, regardless of which party provides the workers' compensation insurance coverage. Current law requires that the employee leasing company provide workers' compensation insurance and be responsible for the management of workers' compensation claims.
