This bill would make it a crime of the third degree to commit the act of "stealthing": removing or damaging a sexually protective device before or during an act of sexual penetration without the consent of the person's sexual partner. The bill defines a "sexually protective device" as a physical device intended to prevent pregnancy or sexually transmitted infection. A crime of the third degree is generally punishable by a term of imprisonment of three to five years or a fine of up to $15,000, or both.
