This bill prohibits provisions in settlement agreements that prevent the disclosure of factual information related to certain claims of sexual assault, sexual harassment, or harassment or discrimination based on sex, filed in a civil or administrative action. It makes such provisions void as a matter of law and against public policy if entered into on or after January 1, 2019. The bill allows for an exception to shield the identity of the claimant and related facts, if requested by the claimant, unless a government agency or public official is a party to the settlement agreement. It also allows the court to consider the pleadings and other records in determining the factual foundation of the claims. The bill does not prohibit provisions that preclude the disclosure of the settlement amount.
