Bill Summary
AB 1390, Committee on Utilities and Commerce. Energy crisis litigation. Prior law, until January 1, 2010, required the Attorney General to represent the Department of Finance and to succeed to all rights, claims, powers, and entitlements of the Electricity Oversight Board in any litigation or settlement to obtain ratepayer recovery for the effects of the 2000-02 energy crisis. That law additionally prohibited the Attorney General from expending the proceeds of any settlements of those claims, except as specified. This bill, until January 1, 2013, would reenact the above-described requirements and authorizations.
AI Summary
This bill extends the authority of the Attorney General to represent the Department of Finance and to take over the rights and claims of the former Electricity Oversight Board in legal actions and settlements aimed at recovering costs for ratepayers affected by the 2000-2002 energy crisis. This extension is in place until January 1, 2013, and it also continues the prior restriction on how settlement funds can be spent, requiring them to be handled according to specific government code sections and water code divisions, and prohibiting the Attorney General from spending settlement proceeds allocated to the Electricity Oversight Board.
