This bill amends Kentucky law to create a definition for "paid prioritization" and requires any contract between the Kentucky Communications Network Authority and public or private internet service providers for access to the KentuckyWired broadband network to include certain provisions. These provisions prohibit the internet service providers from blocking or degrading lawful internet traffic, engaging in paid prioritization, or assigning data caps to broadband services provided through KentuckyWired. The contracts must also provide access to KentuckyWired on a non-exclusive, non-preferential basis, and the authority is required to terminate any contract with a provider that violates these requirements.
