This bill prohibits a court from using a parent, guardian, or custodian's refusal to allow a child to undergo gender-based treatment as a basis for determining custody of the child. It establishes that parents, guardians, or custodians have the fundamental right to withhold consent for gender dysphoria treatment or activities related to a child's conceptions of sex and gender. The bill also requires government agents or entities to notify parents or guardians if a child exhibits symptoms of gender dysphoria, and to obtain written, informed consent from the parents or guardians before authorizing or providing any gender dysphoria treatment. Additionally, the bill establishes a rebuttable presumption of negligence if a medication is administered off-label to a child to treat gender dysphoria and an adverse reaction or injury occurs, and allows for legal action against government agents or entities that fail to comply with the bill's provisions.
