This bill amends the Public Officers Law to require entities that submit records to state agencies that are excepted from disclosure under the Freedom of Information Law (FOIL) to periodically re-apply for the exception. Specifically, the bill requires submitters to request the exception in writing, identify the specific portions of the record that are subject to the request, and state the reasons for the exception. The submitter can also provide an expiration date for the exception, which cannot exceed three years. The submitter must apply for a three-year extension of the exception at least 60 days prior to its expiration, and the agency must review and either grant or deny the extension request. If the submitter fails to apply for an extension, the exception is considered to have expired.
