This bill amends the Penal Law and the Criminal Procedure Law to revoke the probation of a person who is convicted of a felony or an offense in another jurisdiction that would constitute a felony in New York, while the person is under probation supervision for a prior felony conviction. The bill requires the court to sentence the person to a term of imprisonment of over one year, to be served consecutively to the sentence for the new felony, unless the court finds mitigating circumstances and imposes a concurrent sentence. The bill also clarifies that conviction of a subsequent felony while under probation supervision shall result in revocation of probation.
