Bill Summary

To amend title 10, United States Code, to permit additional retired members of the Armed Forces who have a service-connected disability to receive both disability compensation from the Department of Veterans Affairs for their disability and either retired pay by reason of their years of military service or combat-related special compensation. This bill allows the receipt of both military retired pay and veterans' disability compensation with respect to any service-connected disability. Under current law, only service-connected disabilities rated at 50% or more receive both without offset. Individuals who were retired or separated after at least 20 years of military service due to a service-connected disability shall be eligible for the full concurrent receipt of both veterans' disability compensation and either military retired pay or combat-related special pay.

AI Summary

This bill, the Retired Pay Restoration Act, would amend Title 10 of the United States Code to allow additional retired members of the Armed Forces who have a service-connected disability to receive both disability compensation from the Department of Veterans Affairs and their military retired pay or combat-related special compensation. Currently, only service-connected disabilities rated at 50% or more are eligible for the full concurrent receipt of both benefits without offset. This bill would extend this eligibility to all service-connected disabilities, regardless of the disability rating. It would also eliminate the phased-in approach for retirees with non-combat related disabilities between 50-90%, allowing them to receive the full concurrent receipt of both benefits starting in January 2020.
