Bill Summary
AN ACT to amend and reenact section 5-02-13 of the North Dakota Century Code, relating to the removal of an unfinished bottle of wine from a restaurant.
AI Summary
This bill amends North Dakota law to allow a retail alcoholic beverage licensee, whose gross sales of food are at least 30% of the gross sales of alcoholic beverages consumed on the premises, to permit an individual who has purchased a partially consumed bottle of wine in conjunction with a meal to remove the bottle from the licensed premises. The licensee must recork or reseal the bottle and place a receipt of sale with it. This is permitted without the need for an additional license, and is not considered an off-sale of wine.
