This bill eliminates the death penalty and changes provisions relating to murder in the first degree. Specifically: - It changes murder in the first degree from a Class I or Class IA felony to a Class IA felony, punishable by life imprisonment. - It removes language related to the death penalty process, including sections regarding aggravating circumstances, the sentencing determination proceeding, the notice of aggravation, and the jury's role in determining the existence of aggravating circumstances. - It repeals the statutes governing the death penalty and related procedures. - It provides that in any criminal proceeding where the death penalty has been imposed but not carried out prior to the effective date of this act, the penalty shall be changed to life imprisonment.
