This bill establishes the crime of criminal possession of a flamethrower as a Class E felony in New York. It defines a "flamethrower" as a device capable of projecting burning fuel at least three feet, excluding inoperable display units. The bill exempts historical flamethrowers (constructed with pre-1966 components), as well as those used for agricultural or construction purposes, or lawfully acquired before the law's effective date. The bill also permits the manufacture, remanufacture, restoration, or alteration of flamethrower components. The law would take effect 120 days after it becomes law.
