This bill amends the Controlled Substance, Drug, Device and Cosmetic Act to further provide for drug overdose response immunity. Specifically, it states that a person experiencing a drug overdose event may not be charged and shall be immune from prosecution if, within 10 days of receiving medical attention, they obtain a screening and referral for treatment from an accredited addiction services provider. Additionally, a person who transported or reported and remained with someone experiencing a drug overdose event may not be charged and is entitled to immunity, but only if the person experiencing the overdose obtains the required screening and referral within 30 days of receiving written notice. The bill also requires law enforcement or the courts to provide written notice of these requirements to the person experiencing the overdose.
