This bill amends the Pennsylvania Consolidated Statutes to create a new felony offense of "drug delivery resulting in serious bodily injury." Specifically, it makes it a third-degree felony for a person to intentionally administer, dispense, deliver, give, prescribe, sell, or distribute any controlled substance or counterfeit controlled substance, and another person suffers serious bodily injury as a result of using the substance. The bill also directs the Pennsylvania Commission on Sentencing to provide a sentence enhancement within its guidelines for this new offense, and requires the Commission to consider whether the controlled substance was distributed in exchange for any direct or indirect remuneration or consideration when determining the gravity of the offense.
