This bill increases the monetary penalties for violations of public health laws in New York. Specifically, it increases the maximum civil penalty from $2,000 to $5,000 for a first violation, and from $5,000 to $10,000 for a subsequent violation that poses a serious threat to health and safety. Additionally, the maximum penalty for a violation that directly results in serious physical harm to a patient is increased from $10,000 to $20,000. The bill also provides that penalties collected from nursing home operators in excess of $10,000 per violation may be transferred to support the nursing home quality improvement demonstration program.
