This bill allows for the resentencing of individuals convicted of drug offenses under chapters 69.50 or 69.52 of the Revised Code of Washington (RCW) that were committed prior to July 1, 2004. The prosecuting attorney or the offender can request a resentencing hearing, and the court must grant the motion if the offender is serving a sentence for a qualifying offense. At the resentencing, the court will sentence the offender as if they had not previously been sentenced, provided the new sentence is no greater than the initial sentence. However, this resentencing opportunity does not apply to offenders convicted of the most serious or violent offenses. The bill also sets an expiration date of July 1, 2021 for this resentencing process.
