This bill repeals and adds to existing law to prohibit persons from operating a motor vehicle while using a mobile electronic device, with certain exceptions. The bill defines "mobile electronic device" as any handheld or portable electronic device capable of providing wireless data or voice communication, and "operate" as driving or assuming physical control of a motor vehicle in motion. The bill provides exceptions for law enforcement, firefighters, emergency medical personnel, and others acting in their official duties, as well as for emergency purposes, the use of global positioning or navigation systems, and voice-operated or hands-free modes. The bill also prohibits the use of mobile electronic devices while operating a school bus and the use of headphones or earphones in both ears while driving. Violations of this bill are subject to fines and potential driver's license suspension. The state preempts the field of regulating the use of personal electronic devices in motor vehicles while driving, superseding any local laws or regulations.
