AI Summary
This bill reinserts provisions for a Misdemeanor Retail Theft and Theft Diversionary Program. The program allows a court, with the consent of the defendant and the State's Attorney, to continue a case for a person arrested and charged with a misdemeanor offense of theft or retail theft, if the person has not previously been convicted of certain financial crime enterprise offenses. The program lasts at least 12 months and requires the defendant to meet certain conditions, such as not violating any criminal statutes, refraining from possessing firearms or other dangerous weapons, and making full restitution to the victim plus 10% of the cost of the stolen item. If the defendant successfully completes the program, the case is dismissed, but a person can only receive this one-time discharge and dismissal within a 3-year period.
