This bill prohibits state agencies in Texas from including questions about an applicant's criminal history on initial employment application forms. However, state agencies can inquire about and consider an applicant's criminal history record information after determining that the applicant is otherwise qualified and has been conditionally offered the position. This exception does not apply to positions involving services to or direct interaction with children, or for positions where criminal history consideration is required by law.
