This bill requires that certain evidence of the usual and customary rates for health care services, procedures, or equipment be introduced at trial in personal injury or wrongful death actions. Specifically, it requires the introduction of evidence of government program rates or the range of allowed amount benchmarks from the 50th to 95th percentile if the claimant has commercial insurance coverage but receives services out-of-network, or the range of charge benchmarks from the 50th to 95th percentile if the claimant does not have coverage. The bill applies only to actions arising on or after the effective date and has no other application or effect regarding compensation paid to health care providers.
