This bill creates a defense to prosecution for certain offenses involving possession of small amounts of controlled substances, prohibited drugs, substances, chemicals, or paraphernalia if the person was the first to request emergency medical assistance in response to a possible overdose and remained on the scene, cooperating with medical and law enforcement personnel. This defense is not available if the person was committing another offense, has a prior conviction or deferred adjudication for a similar offense, or was acquitted in a previous proceeding where this defense was successfully established. The bill applies to offenses committed on or after September 1, 2019.
