This bill amends Section 10 of Chapter 40A of the General Laws in Massachusetts. The key provisions are: 1) If the rights granted by a zoning variance are not exercised within one year of the variance being granted, those rights will lapse. However, the permit granting authority can, at its discretion, extend the time for exercising the variance rights by up to an additional six months upon written application by the grantee, as long as the application is filed before the original one-year period expires. 2) If the permit granting authority does not grant the extension within 30 days of the application, then the variance rights will expire at the end of the original one-year period. To reestablish those rights after expiration, a new notice and public hearing is required under the existing law.
