This bill amends a previous law to require that the survey of the parcel leased by non-profit yacht clubs and other non-profit organizations operating boating programs include navigable channels and berthing/mooring areas on the water sheet, and establish a schedule for maintenance of navigable waters from each boating facility. It also requires the Commissioner of Capital Asset Management and Maintenance and the Commissioner of Conservation and Recreation to manage, operate, improve, repair, and maintain the land under water for the term of the lease to ensure recreational boating waterside access and the protection of navigable waterways and channels. Additionally, the bill requires that the lease fees reflect adequate access to navigable waters for recreational boating and mooring, and ensure the capacity for water-dependent uses.
