This bill establishes a Drug Cost Review Commission within the Executive Office for Administration and Finance in Massachusetts. The Commission will be an independent public entity tasked with protecting state residents, governments, commercial health plans, providers, and other stakeholders from excessive prescription drug costs. The bill outlines the Commission's governing structure, powers, and duties, including developing a plan of operation, adopting rules and regulations, and entering into agreements. The Commission will also create a Drug Cost Review Advisory Council to provide stakeholder input. Manufacturers of certain brand-name, generic, and off-patent drugs will be required to notify the Commission of significant price increases or the introduction of high-cost drugs, and the Commission can then review those drugs to determine if they create "excess costs" for the healthcare system. If so, the Commission can establish reimbursement rates that must be followed by payors, pharmacies, and consumers.
