This bill amends Chapter 111 of the General Laws to prohibit integrated health care systems from jointly negotiating contracts with public and private payers. The key provisions require each facility within a larger system to negotiate separate contracts, establish separate negotiating teams, and implement firewalls to prevent the sharing of information that could inhibit competition. The bill also prohibits contract contingencies that would limit a payer's ability to contract with other providers. The Department of Public Health and the Office of the Attorney General are given authority to enforce these requirements, and the Department may grant exemptions if a system demonstrates it is sufficiently integrated based on factors such as alternative payment arrangements, interoperable electronic medical records, quality improvement initiatives, and measures to eliminate unnecessary duplication.
